1. Agreement to Terms

By accessing or using My Tool Tracking ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

These Terms apply to all visitors, users, and others who access or use the Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms.

2. Service Description

My Tool Tracking is a cloud-based inventory management platform designed for tracking tools, parts, and stock. We provide various subscription plans with different features and usage limits.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. Account Registration

To use the Service, you must register for an account by providing accurate, current, and complete information. You are responsible for safeguarding your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to comply with this section.

4. Subscription and Billing

The Service is provided on a subscription basis. By subscribing, you agree to pay the fees specified for your chosen plan. Subscription fees are billed in advance on a monthly or annual basis, as selected during checkout.

All fees are non-refundable except as required by law or as explicitly stated in our Refund Policy (Section 10). We reserve the right to change our pricing with 30 days' notice. Price changes will not affect your current billing cycle but will apply to subsequent renewal periods.

If payment is not received by the due date, we may suspend or terminate your access to the Service. You are responsible for any taxes, duties, or other charges that may apply to your subscription.

5. Free Trial

We may offer a free trial period for new users. During the free trial, you have full access to the Service features available in your selected plan. No credit card is required to start a free trial.

If you do not cancel before the end of the free trial period, your subscription will automatically begin and you will be charged according to your selected plan. You may cancel at any time during the free trial without being charged.

6. Cancellation

You may cancel your subscription at any time through your account settings or by contacting our support team. Cancellation will take effect at the end of your current billing period.

Upon cancellation, you will continue to have access to the Service until the end of your paid billing period. After cancellation, your account will be downgraded to a free tier (if available) or your data will be retained for a limited period as specified in our Data Retention Policy.

7. User Content and Data

You retain all ownership rights to the data and content you upload to the Service ("User Content"). By using the Service, you grant us a limited, non-exclusive license to store, process, and display your User Content solely for the purpose of providing the Service to you.

You are solely responsible for your User Content and warrant that you have all necessary rights to upload and use such content. You agree not to upload any content that:

  • Violates any applicable laws or regulations
  • Infringes on the intellectual property rights of others
  • Contains viruses, malware, or other harmful code
  • Is defamatory, obscene, or otherwise objectionable

We reserve the right to remove any User Content that violates these Terms or is otherwise objectionable, in our sole discretion.

8. Intellectual Property

The Service, including its original content, features, and functionality, is owned by My Tool Tracking and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of the Service or included software, nor may you reverse engineer or attempt to extract the source code of that software, unless laws prohibit those restrictions or you have our written permission.

9. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Service in any way that violates any applicable law or regulation
  • Attempt to gain unauthorized access to the Service or related systems
  • Interfere with or disrupt the Service or servers connected to the Service
  • Use automated systems (bots, scrapers) to access the Service without permission
  • Share your account credentials with others or allow unauthorized access
  • Use the Service to transmit any malicious code or spam

Violation of these restrictions may result in immediate termination of your account without refund.

10. Refund Policy

We want you to be satisfied with My Tool Tracking. If you are not completely satisfied with your subscription, you may request a refund within 30 days of your initial purchase or subscription renewal.

Refund Eligibility:

  • Refund requests must be made within 30 days of the purchase or renewal date
  • Refunds are only available for the current billing period
  • Refunds will be processed to the original payment method within 5-10 business days
  • Partial refunds may be provided for unused portions of annual subscriptions on a prorated basis

Non-Refundable Items:

  • Subscriptions that have been active for more than 30 days
  • Fees for services already rendered or consumed
  • Accounts terminated for violation of these Terms

We reserve the right to refuse refunds in cases of abuse, fraud, or violation of these Terms. This refund policy does not affect your statutory rights as a consumer.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that defects will be corrected. We do not warrant or make any representations regarding the use or the results of the use of the Service in terms of its correctness, accuracy, reliability, or otherwise.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL MY TOOL TRACKING, ITS AFFILIATES, AGENTS, DIRECTORS, EMPLOYEES, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO THE USE OF, OR INABILITY TO USE, THE SERVICE.

Our total liability for any claims arising from or related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim, or one hundred dollars ($100), whichever is greater.

13. Indemnification

You agree to indemnify, defend, and hold harmless My Tool Tracking and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the Service, your User Content, or your violation of these Terms.

14. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Service will immediately cease. If you wish to terminate your account, you may simply discontinue using the Service or cancel your subscription as described in Section 6.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.

What constitutes a material change will be determined at our sole discretion. By continuing to access or use the Service after those revisions become effective, you agree to be bound by the revised terms.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which My Tool Tracking operates, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Service shall be resolved in the appropriate courts of that jurisdiction.
